Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying martyrs for years, a extending claimant advocate said here on Friday.
Brett Dixon, the new president of the Association of Personal Injury advocates, criticized the industry's attitude to the recently revised" Ogden Rate ," which courts use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the improve, which they knew was coming, many of them were resting on their laurels, deriving the benefits of a rate which was too low, while people with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a vehement sequence over the direction insurers pay out lump sums to cover casualties' future maintenance cost and lost earnings.
