Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying victims for years, a resulting claimant advocate said on Friday.
Brett Dixon, the new chairman of the Association of Personal Injury solicitors, assaulted the industry's position to the recently revised" Ogden Rate ," which courts use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the improvement, which they knew was developing, many of them were resting on their laurels, collecting the benefits of a proportion which was too low, while beings with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a vehement sequence over the direction insurers pay out lump sums to cover preys' future attention costs and lost earnings. The Justice Ministry announced the first change to the compensation formula in 16 times, lashing the rate from 2.5 percent to -0.75 percent -- and feelings the industry .
