Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying martyrs for years, a resulting claimant solicitor said here on Friday.
Brett Dixon, the new chairman of the Association of Personal Injury advocates, attacked the industry's posture to the recently modified" Ogden Rate ," which courts use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the reconstruct, which they knew was going, many of them were resting on their laurels, reaping the added benefit of a rate which was too low, while people with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a raging row over the route insurers pay out lump sums to cover casualties' future upkeep cost and lost earnings. The Justice Ministry announced the first change to the compensation formula in 16 years, slashing the rate from 2.5 percent to -0.75 percent -- and indignation service industries .
