Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying preys for years, a producing claimant advocate said on Friday.
Brett Dixon, the brand-new president of the Association of Personal Injury lawyers, criticized the industry's sentiment to the recently modified" Ogden Rate ," which courts use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the improve, which they knew was running, many of them were resting on their laurels, deriving the added benefit of a frequency which was too low, while parties with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a ferocious row over the mode insurers pay out lump sums to cover victims' future help cost and lost earnings. The Justice Ministry announced the first change to the compensation formula in 16 times, lashing the rate from 2.5 percent to -0.75 percent -- and angering the industry .

But Dixon countered that the insurance industry was inflating security threats posed by the Ogden rate and rejected the suggestion that tough improves would force insurers out of business .

Justice Minister and Lord Chancellor Elizabeth Truss said in February that she had manufactured the change legally and acted with freedom .
" The rule is very clear: As baron chancellor, I must make sure the right pace is set to compensate claimants ," Truss answered." I am clear that this is the only legally acceptable frequency I can rectify ."
