Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying scapegoats for years, a contributing claimant solicitor said on Friday.
Brett Dixon, the brand-new chairman of the Association of Personal Injury solicitors, affected the industry's stance to the recently revised" Ogden Rate ," which courts use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the improve, which they knew was passing, many of them were resting on their laurels, deriving the added benefit of a frequency which was too low, while people with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .

Justice Minister and Lord Chancellor Elizabeth Truss said in February that she had fixed the change legally and acted with freedom .
" The statute is absolutely clear: As sovereign chancellor, I must make sure the right frequency is set to compensate claimants ," Truss suggested." I am clear that this is the only legally acceptable pace I can set ."
