Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying victims for years, a resulting claimant solicitor said here on Friday.
Brett Dixon, the new president of the Association of Personal Injury lawyers, attacked the industry's stance to the recently modified" Ogden Rate ," which courts use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the improvement, which they knew was arriving, many of them were resting on their laurels, reaping the benefits of a frequency which was too low, while parties with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a intense sequence over the highway insurers pay out lump sums to cover victims' future help costs and lost earnings.
