Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying preys for years, a conducting claimant lawyer said on Friday.
Brett Dixon, the new president of the Association of Personal Injury advocates, assaulted the industry's demeanour to the recently revised" Ogden Rate ," which courts use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the reorganize, which they knew was approaching, many of them were resting on their laurels, deriving the added benefit of a pace which was too low, while people with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .

" A society will be judged on the basis of how it considers its weakest members ," he said." We had all better sit up, take notice and try to be better, fairer human beings ."
Justice Minister and Lord Chancellor Elizabeth Truss said in February that she had shaped the change legally and behaved with independence .
" The law is very clear: As aristocrat chancellor, I must make sure the right pace is set to compensate claimants ," Truss answered." I am clear that this is the only legally acceptable proportion I can mount ."
