Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying martyrs for years, a contributing claimant advocate said here on Friday.
Brett Dixon, the new chairman of the Association of Personal Injury lawyers, affected the industry's posture to the recently modified" Ogden Rate ," which law use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the improve, which they knew was returning, many of them were resting on their laurels, collecting the added benefit of a pace which was too low, while parties with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a relentless row over the road insurers pay out lump sums to cover casualties' future charge costs and lost earnings. Justice Minister and Lord Chancellor Elizabeth Truss said in February that she had stirred the change legally and acted with impartiality .
" The rule is absolutely clear: As monarch chancellor, I must make sure the right rate is set to compensate claimants ," Truss read." I am clear that this is the only legally acceptable rate I can name ."
