Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying victims for years, a leading claimant solicitor said here on Friday.
Brett Dixon, the new chairman of the Association of Personal Injury lawyers, criticized the industry's posture to the recently revised" Ogden Rate ," which courts use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the reconstruct, which they knew was changing, many of them were resting on their laurels, deriving the benefits of a charge which was too low, while beings with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a vehement sequence over the method insurers pay out lump sums to cover martyrs' future maintenance costs and lost earnings. The Justice Ministry announced the first change to the compensation formula in 16 years, reducing the rate from 2.5 percentage to -0.75 percent -- and indignation service industries .
