Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying preys for years, a contributing claimant lawyer said here on Friday.
Brett Dixon, the brand-new president of the Association of Personal Injury lawyers, affected the industry's position to the recently revised" Ogden Rate ," which law use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the reconstruct, which they knew was happening, many of them were resting on their laurels, reaping the benefits of a charge which was too low, while parties with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a fierce sequence over the channel insurers pay out lump sums to cover casualties' future care costs and lost earnings. The Justice Ministry announced the first change to the compensation formula in 16 times, lashing the rate from 2.5 percentage to -0.75 percentage -- and feelings service industries .

Justice Minister and Lord Chancellor Elizabeth Truss said in February that she had attained the change legally and behaved with sovereignty .
" The statute is absolutely clear: As monarch chancellor, I must make sure the right pace is set to compensate claimants ," Truss responded." I am clear that this is the only legally acceptable pace I can name ."
