Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying preys for years, a heading claimant lawyer said on Friday.
Brett Dixon, the new president of the Association of Personal Injury lawyers, attacked the industry's sentiment to the recently modified" Ogden Rate ," which courts use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the reorganize, which they knew was reaching, many of them were resting on their laurels, deriving the added benefit of a rate which was too low, while people with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a ferocious row over the acces insurers pay out lump sums to cover scapegoats' future help cost and lost earnings. The Justice Ministry announced the first change to the compensation formula in 16 times, slashing the rate from 2.5 percentage to -0.75 percent -- and feelings service industries .
