Insurers Guilty Of Ogden Rate Hysteria, Top Lawyer Says

Law3 60, London( May 19, 2017, 11:32 AM BST) -- U.K. insurers have reacted with "hysteria" to the government's tougher new personal injury compensation formula and have been underpaying victims for years, a passing claimant solicitor said on Friday.
Brett Dixon, the brand-new president of the Association of Personal Injury lawyers, criticized the industry's position to the recently revised" Ogden Rate ," which law use to calculate lump sums for serious injuries .
" While insurers should have been preparing for the improvement, which they knew was emanating, many of them were resting on their laurels, collecting the added benefit of a proportion which was too low, while parties with life-changing injuries were under-compensated ," Dixon told an association meeting in Cardiff .
The government's change to the Ogden rate in February has fuelled a fierce row over the highway insurers pay out lump sums to cover casualties' future attention cost and lost earnings. The Justice Ministry announced the first change to the compensation formula in 16 years, lashing the rate from 2.5 percent to -0.75 percentage -- and indignation the industry .
The rate is designed to make it easier to calculate future damages in personal injury and fatal accident clients. It takes into account the speculation that compensation will gain fascinate over era, especially with larger gifts for those who are most seriously injured .

Justice Minister and Lord Chancellor Elizabeth Truss said in February that she had seen the change legally and acted with liberty .
" The principle is absolutely clear: As aristocrat chancellor, I must make sure the right proportion is set to compensate claimants ," Truss answered." I am clear that this is the only legally acceptable rate I can set ."
